What is the Case Against BASF for Unpaid Wages About?
The lawsuit alleges that BASF expects its production/manufacturing employees to put on certain safety clothing and personal protective equipment (“PPE”) such as chemical/fire resistant clothing, hard hats, eye protection, work boots, and other equipment and tools such as a radio before the scheduled start of their shifts. The lawsuit alleges that BASF’s production/manufacturing employees also routinely stayed past their schedule shift end time to remove the protective clothing and PPE. However, the lawsuit alleges that BASF failed to pay these employees for this pre- and post-shift work, resulting in unpaid overtime.
If I Am Eligible and Choose to Join the BASF Lawsuit, What Could I Potentially Receive From It?
If we can show that you were not properly paid for all overtime work performed for one or more reason(s), the law states that you could receive (1) unpaid overtime for up to the last three years of work; and (2) liquidated damages in an amount equal to the unpaid overtime (aka the potential for double [2x or 200%] damages). Can BASF Retaliate Against Me for Joining the Lawsuit?
No. The Fair Labor Standards Act prohibits employers from retaliating against employees who participate in wage and hour cases.
