What Is This New Lawsuit Against Atkore About?

The new lawsuit claims that Atkore requires its hourly production/manufacturing employees to arrive before the scheduled start of their shifts and engage in pre-shift activities such as putting on certain safety clothing and personal protective equipment (“PPE”) such as eye protection, gloves, a headset, cutters, and other items, as well as going through a “shift passdown” process which consisted of speaking with the incoming employee to discuss issues that occurred and expectations for the ongoing shift. At the end of their shift, these employees would similarly have a “shift passdown” process with the incoming shift, and remove their safety clothing and equipment.

However, the lawsuit alleges that Atkore does not pay its hourly production/manufacturing employees for this time, and instead only pays these employees based on the scheduled time of their shifts, instead of including the actual pre- and post-shift time worked.

The new unpaid wages lawsuit against Atkore also states that Atkore has failed to include certain forms of payment such as shift differentials into how it calculates overtime rates. This failure has also resulted in Atkore failing to properly compensate its hourly production/manufacturing employees for all overtime they have earned.

If I Chose to Join This Lawsuit, What Could I Receive?

If we can show in the lawsuit that you were not properly paid for all overtime work performed for one or more reason(s), the law states that you could receive (1) unpaid overtime for up to the last three years of work; and (2) liquidated damages in an amount equal to the unpaid overtime (aka the potential for double [2x or 200%] damages). If the lawsuit is successful, the law also requires Atkore to pay the firm’s attorneys’ fees and costs.
