Our experienced unpaid wages attorneys have a major update to share in the currently pending meal break and unpaid wages lawsuit against Adena Health System. The judge overseeing the lawsuit has recently ruled that there is a strong likelihood that Adena’s healthcare employees over the past three years are similarly situated (meaning they performed the same tasks, were subject to the same pay and time policies, and were possibly denied all the overtime wages that they earned).

What Does This Mean For Me?

Because of this, the Court has ordered that all hourly, non-exempt healthcare employees who worked for Adena between November 17, 2020 and the present be sent notice of this lawsuit and given the opportunity to join and potentially receive a share of any settlement.

This notice will be sent out to all eligible healthcare employees by email and U.S. mail, and the consent form attached to the notice must be returned by the deadline included in the notice and consent in order to join the case and be eligible to receive a portion of any settlement. Some individuals may also receive a text message version of the notice and consent form.

What Could I Potentially Recover If I Join the Lawsuit?

If you are eligible to participate in the lawsuit and choose to join, you will be entitled to share in any settlement or judgment that is received. If we can demonstrate that you were not properly paid for all overtime work performed for one or more reason(s), the law provides that you could receive the following: (1) unpaid overtime for up to the last three years of work; (2) liquidated damages in an amount equal to the unpaid overtime (i.e., the potential for double [2x or 200%] damages); (3) attorneys’ fees and costs; and (4) other miscellaneous relief.

In this case, we are seeking all of the unpaid overtime that hourly healthcare employees incurred over the applicable timeframe covered by the case as well as liquidated damages, fees, costs, and other relief provided under the law.

What If I Have Not Received a Notice or Consent Form?

If you did not receive a copy of the Court-Approved Notice or the consent form, that does not necessarily mean that you cannot participate in the lawsuit. The notice is being sent by mail and email. For the notices sent by mail, we may not have been provided with your current mailing address, or the notice may have gotten lost. As with the mail, you may not receive the email notice because we were not provided with your current email address, or we may not have an email address at all. If the notice was emailed to the correct address, it may also get stuck in a “spam” or “junk” folder even though the notice and consent are Court-ordered documents and not solicitations.

Additionally, in many cases, some individuals are otherwise eligible to join who are left off of the notice list for unknown reasons.

What If I Already Provided My Information On a Website?

Our law firm was made aware that an anonymous account on Facebook called “Blimp Arms” set up a website supposedly allowing employees to join the lawsuit by inputting their contact information. This website was set up and maintained entirely without our knowledge, participation, or encouragement. Importantly, this website is not how eligible individuals can join the lawsuit against Adena.

If you provided your information on this website but have not, since then, completed and returned a consent form to our firm, then you are not currently an opt-in plaintiff in this case and will not receive any potentially recovered money unless you complete and return the enclosed Consent Form.
