The experienced employment lawyers at Coffman Employment Lawyers have filed a new suit against Michelman, Inc. on behalf of its hourly production/manufacturing employees throughout the United States. The lawsuit alleges that Michelman’s hourly production/manufacturing employees remain at work after their shift to complete a shift turnover/shift change process with the incoming shift and were not properly compensated for all of the overtime hours they worked.
Michelman, Inc. is a large manufacturer and distributor of coating and packaging products that are used in a variety of industries. Michelman currently own, operates, and/or manages six facilities located across the United States.
What is the New Overtime Lawsuit About?
The unpaid wages lawsuit alleges that Michelman required its production/manufacturing employees to stay after the end of their scheduled shift in order to have a post-shift meeting with the incoming shift. Despite the fact that these meetings concerned work-related matters such as problems that arose in the past shift and information crucial to the next shift’s work, Michelman allegedly did not pay its employees for this working time, resulting in unpaid overtime.
If I Join This Lawsuit, What Could I Be Eligible to Receive?
In order to join, you must be eligible and we must be able to show that you were not properly paid all of the overtime wages you were owed. If we are able to show that your claims are like those of other employees and if we are successful in the lawsuit, the law states that you could receive (1) unpaid overtime for up to the last three years of work; and (2) liquidated damages in an amount equal to the unpaid overtime (a.k.a. the potential for double damages). If we are successful, Michelman will also have to pay our firm’s attorneys’ fees and costs.
Can Michelman Retaliate Against Me if I Join the Lawsuit?
No. The federal Fair Labor Standards Act prohibits employers from retaliating against employees who join a lawsuit for unpaid overtime wages. If Michelman were to retaliate against you, it may be held liable for additional damages including reinstatement, back pay, and liquidated damages (double damages). If you believe you are experienced retaliation or are concerned about retaliation, please contact our experienced employment attorneys so we can explain your rights and protections.
