The experienced unpaid overtime lawyers at Coffman Employment Lawyers have recently filed a new unpaid overtime lawsuit against Aunt Millie’s. This new lawsuit seeks to recover unpaid overtime wages for all hourly production/manufacturing and maintenance employees of Aunt Millie’s who worked during the last 3 years.

Aunt Millie’s is a trade name for Perfection Bakeries, Inc., which manufactures and distributes breads and baked goods across the country. Aunt Millie’s operates 5 production/manufacturing plants across the Midwest, within Ohio, Michigan, and Indiana.

What Is This New Lawsuit Against Aunt Millie’s About?

The new lawsuit claims that Aunt Millie’s requires its hourly production/manufacturing and maintenance employees to arrive before the scheduled start of their shifts and engage in pre-shift activities such as putting on certain sanitary clothing and personal protective equipment (PPE).

However, the lawsuit alleges that Aunt Millie’s does not pay its hourly production/manufacturing and maintenance employees for this time. Because oft his alleged failure to pay for this time, the lawsuit claims that Aunt Millie’s has not paid these employees for all the overtime wages that they have earned.

If I Chose to Join This Lawsuit, What Could I Potentially Receive?

If we can show that you were not properly paid for all the overtime hours you worked for one or more reason(s), the law states that you could receive (1) unpaid overtime for up to the last three years of work; and (2) liquidated damages in an amount equal to the unpaid overtime (aka the potential for double [2x or200%] damages). If the lawsuit is successful, the law also requires Aunt Millie’s to pay the firm’s attorneys’ fees and costs.

Can Aunt Millie’s Retaliate Against Me for Joining the lawsuit?

No. The Fair Labor Standards Act prohibits employers from retaliating against its employees for participating in wage and hour lawsuits like this one. If Aunt Millie’s does retaliate against you, it could be required to pay damages, including back pay, liquidated damages, and/or reinstatement. The U.S. Department of Labor website contains more information about how to protect yourself from retaliation: click here.
