
Coffman Employment Lawyers recently filed a new lawsuit for unpaid wages against Tri-Tech Laboratories, LLC doing business as KDC/One. We are alleging that KDC/One violated federal law by deducting wages from hourly production and manufacturing employees for meal breaks they did not take or were unable to take without being interrupted by job duties.
What is the KDC/One Lawsuit About?
The lawsuit alleges that KDC/One deducted 30 minutes from its production and manufacturing employees’ hours as a “meal break,” even when those employees did not actually receive such a break.
Federal law requires employers to pay their employees overtime (time-and-a-half) if they work more than 40 hours during a given work week. We allege that KDC/One has failed to do so because of its meal break deduction without actually granting employees a bona fide meal break. A bona fide meal break is when an employee gets a 30-minute meal break that is uninterrupted. If an employee could not take their meal break or their meal break was interrupted by work tasks, KDC/One has not given them a bona fide meal period and cannot deduct 30 minutes from their hours worked.
What Could I Get From the KDC/One Lawsuit if I Am Eligible to Join?
If our firm can prove that KDC/One did not pay all of the overtime wages that you are owed, you may be able to receive (1) unpaid overtime you earned over the last three years; and (2) liquidated damages equal to the amount of unpaid overtime (the potential for double damages). If we prevail, KDC/One must also pay our firm’s attorneys’ fees and costs.
Can KDC/One Retaliate Against Me for Joining the Lawsuit?
No. A federal law called the Fair Labor Standards Act prohibits KDC/One from retaliating against its employees for participating in these kinds of lawsuits. If KDC/One does retaliate, it could be required to pay damages, including back pay, liquidated damages, and/or reinstatement.
