Background picture

The experienced unpaid wages attorneys at Coffman Employment Lawyers have filed a new lawsuit against The Lubrizol Corporation (“Lubrizol”) alleging that Lubrizol failed to compensate its hourly production/manufacturing employees for all the overtime hours they worked before their scheduled shifts.

Lubrizol Corporation is a global chemical company that develops and manufactures chemical solutions across the United States.

What Is the Case Against Lubrizol for Unpaid Wages About?

Specifically, the lawsuit alleges that Lubrizol’s hourly production/manufacturing employees regularly arrive at their facilities before the scheduled start of their shifts to put on certain safety clothing and personal protective equipment (“PPE”). After putting on this safety clothing and PPE, the lawsuit alleges that Lubrizol’s hourly production/manufacturing employees engage in a shift change/shift relief discussion with the outgoing shift to go over the state of production, problems or hazards to be aware of, and what might need to be done during the upcoming shift.

However, the lawsuit alleges that Lubrizol does not pay its hourly production/manufacturing employees for this time before their scheduled shifts. If you performed these activities or other work activities before your scheduled shifts, it is possible that you were not paid all the overtime wages you were entitled to.

If I Am Eligible and Choose to Join the Lubrizol Lawsuit, What Could I Potentially Receive from It?

If we can show that you were not properly paid for all overtime work performed for one or more reason(s), the law states that you could receive (1) unpaid overtime for up to the last three years of work; and (2) liquidated damages in an amount equal to the unpaid overtime (aka the potential for double [2x or200%] damages). If the lawsuit is successful, the law also requires Lubrizol to pay our firm’s attorneys’ fees and costs.

Can Lubrizol Retaliate Against Me for Joining the Lawsuit?

No. The Fair Labor Standards Act prohibits employers from retaliating against employees who participate in wage and hour cases. If Lubrizol retaliates, it may be held liable for reinstating you or paying damages, including back pay and double damages (liquidated damages). For more information about retaliation, see the U.S. Department of Labor’s website here. If you have experienced retaliation or are otherwise concerned about retaliation, please contact our firm using the information below for an explanation of your rights and protections.
