The skilled employee misclassification lawyers at Coffman Legal have recently filed a new lawsuit against Pioneer Production Services, Inc. (“Pioneer”) and Encino Energy LLC (“Encino”) (Pioneer & Encino collectively “Defendants”). This new lawsuit alleges that Pioneer and Encino have a policy of misclassifying day-rate employees as independent contractors and not paying them overtime.
What are the Allegations of the Overtime Lawsuit?
The lawsuit states that some of Pioneer’s and Encino’s employees are classified as independent contractors and paid a flat day rate for each day worked. They are the date rate regardless of how many hours they worked that day or during that week. However, the lawsuit alleges that because Defendants control all the significant or meaningful aspects of the job duties these day-rate employees perform, they are incorrectly classified (or misclassified) as independent contractors and should be paid overtime.
Am I Eligible to Join the Lawsuit?
If you worked for either Pioneer Production Services, Inc. or Encino Energy, LLC and were classified as an independent contractor who was paid a day rate with no overtime, it is possible that you were not properly paid the overtime compensation to which you were entitled.
The new lawsuit was filed in the United States District Court for the Southern District of Ohio, Eastern Division, and is called Fontenot v. Encino Energy, LLC and Pioneer Production Services, Inc., Case Number 2:25-cv-228. The lawsuit seeks to recover the unpaid wages for all of Defendants’ affected day rate employees during the past three years.
What Could I Get from the Unpaid Overtime Lawsuit?
If we demonstrate that you and other day-rate workers were employees entitled to overtime pay, then you could receive your unpaid overtime, liquidated damages equal to your unpaid overtime (or double damages), and attorney’s fees and costs. If you have questions about your potential recovery by joining the lawsuit, please speak with our experienced employment lawyers.
