New Unpaid Overtime Lawsuit Against Pioneer Production Services And Encino Energy

The lawsuit states that some of Pioneer’s and Encino’s employees are classified as independent contractors and paid a flat day rate for each day worked. They are the date rate regardless of how many hours they worked that day or during that week. However, the lawsuit alleges that because Defendants control all the significant or meaningful aspects of the job duties these day-rate employees perform, they are incorrectly classified (or misclassified) as independent contractors and should be paid overtime.
